1.- Conditions for access to and utilisation of this Website

1.1. Access to the Website, contents and information.

Access to this Webpage is the exclusive responsibility of the user, supposing likewise the acceptance and knowledge of the legal warnings, conditions and terms for utilisation contained therein.

INSTITUCIÓN EDUCATIVA SEK S.L. reserves the right to carry out, at any moment, as many changes and modifications it deems convenient and necessary for improving the Webpage, without needing to give prior notice.

The User guarantees the authenticity and truthfulness of all the data remitted while completing the registration forms, as well as at any other time subsequent to the same, being fully responsible likewise for updating the information submitted, in such a manner that it reflects the actual situation. The user shall be responsible for any inaccuracy or lack of truthfulness in the information submitted.

1.2 Responsibility for the proper use of the Webpage and its contents.

The User undertakes to properly utilise the Website and utilities provided thereby pursuant to law, including this legal notice and the instructions and notices that may be communicated to the same.

(b) induces, incites or promotes violent, slanderous, defamatory, derogatory, criminal actions or, in general, failure to comply with the law, morality and generally accepted principles of morality or public order;

(c) induces, incites or promotes actions, attitudes or discriminatory thinking due to sex, race, religion, beliefs, age or status;

(d) incorporates, makes available or allows access to products, elements, messages and/or services that are degrading, harmful, offensive, violent, criminal or, in general, contrary to the law, morality and generally accepted principles of morality or public order;

(e) is false, ambiguous, inaccurate, exaggerated or extemporaneous, in such a manner that it induces or may induce to error regarding the subject matter or the intentions or purposes of the reporting party;

(f) is protected by any intellectual or industrial property rights of third parties, and where the required authorization, for the use in question, has not been obtained by the User from the owners of the corresponding rights;

(g) infringes upon the business secrets of third parties;

(i) it undermines in any way the credit of INSTITUCIÓN EDUCATIVA SEK S.L. or of third parties;

(k) constitutes, as the case may be, unlawful, deceitful or disloyal publicity and, in general, results in unfair competition;

(l) incorporates viruses or other physical or electronic elements that may damage or prevent the normal operation of the network, of the system or of computer equipment (hardware and software) of INSTITUCIÓN EDUCATIVA SEK S.L. or of third parties, or that may damage the electronic documents and files stored in said computer equipment;

(m) where, due to its characteristics (such as format, file extension, etc.), it causes difficulties in the normal operation of the Service;

In accordance with the aforementioned, Users undertake to make use of the content put at their disposal on the Website, with the understanding that these include, but are not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the “Contents”), pursuant to law, this Legal Notice, other notices, regulations of use and instructions made known to the same, as well as that related to morality and generally accepted principles of morality or public order, and, particularly, users shall undertake not to:

(a) reproduce, copy, distribute, make available or communicate publicly in any manner, transform or modify the Contents, unless authorisation is granted from the holder of the corresponding rights or it is legally permitted;

(b) delete, manipulate or in any manner alter the “copyright” and other identifying data of the reservation of rights of INSTITUCIÓN EDUCATIVA SEK S.L., of the digital fingerprinting or of any other technical means established for its recognition.

The User undertakes to respect the industrial property rights of INSTITUCIÓN EDUCATIVA SEK S.L., and of any other third party. The use or the concession of access to the Webpage does not entail the granting of any right regarding brands, trade names or any other distinctive symbol that is utilised on the same.

INSTITUCIÓN EDUCATIVA SEK S.L. does not guarantee the availability and continuous operation of the Website. Where reasonably possible, neither does INSTITUCIÓN EDUCATIVA SEK S.L. guarantee the usefulness of the Website for performing any specific activity, nor the infallibility thereof.

Access to the Website is for an indefinite term; nevertheless, INSTITUCIÓN EDUCATIVA SEK S.L. reserves the right to discontinue, without prior notice, the access of Users who, in its sole judgement, do not comply with the rules for utilising its Webpage, and to exercise any appropriate legal actions. INSTITUCIÓN EDUCATIVA SEK S.L. undertakes to comply with the legislation in force regarding personal data protection contained in Constitutional Law 15/1999, and other additional regulations that develop the same.

The personal data submitted by Users, in the forms being completed, shall be treated and incorporated by INSTITUCIÓN EDUCATIVA SEK S.L. into files owned by the same that are registered with the Data Protection Agency, adopting the corresponding security measures, as required by the legislation in force, for ensuring the non-disclosure thereof.

INSTITUCIÓN EDUCATIVA SEK S.L. shall neither communicate nor transfer personal data to third parties, treating the same with adequate confidentiality, unless authorised otherwise.

Users may exercise their rights of access, correction, cancellation and objection by way of written communication, according to the legally established method, addressing the same to INSTITUCIÓN EDUCATIVA SEK S.L. under the terms provided by law.

5 .- Legislation and jurisdiction

The service provision is governed by Spanish law, wherefore Users hereby expressly submit to the Courts of Madrid, which are duly competent in this matter.
